Terms of Service

These Terms govern use of the ChargebackWiz Shopify application and website, operated by [LEGAL ENTITY NAME] ("ChargebackWiz", "we"). By installing the app or using the site, you ("Merchant", "you") agree to these Terms.
1. The service
ChargebackWiz helps merchants manage payment disputes ("chargebacks") on Shopify by monitoring disputes, assembling evidence from the merchant's store data, and submitting responses through Shopify's dispute APIs, either manually (on your click) or automatically (auto-pilot, if enabled by you).
2. No guarantee of outcomes — read this section carefully
Chargeback decisions are made solely by the customer's card-issuing bank and card networks, not by ChargebackWiz or Shopify. We do not and cannot guarantee that any dispute will be won, that any funds will be recovered, or any particular win rate. Win Scores, projections, and recommendations are informational estimates only and are not promises, financial advice, or legal advice. You remain solely responsible for the accuracy of your store's data, your policies, and your decisions, including enabling auto-pilot or auto-refund features.
3. Fees and billing
- Plans are described on the Billing page in the app. Paid amounts are charged via the Shopify Billing API on your Shopify invoice.
- Success fee: we charge a percentage of the recovered amount only when (a) a dispute is decided in your favor, and (b) the evidence was submitted through ChargebackWiz. Disputes you fight outside the app are never charged.
- Success fees are non-refundable once the corresponding dispute is finally decided in your favor, including if the customer later returns goods or you voluntarily refund them.
- We may change pricing with 30 days' notice; changes apply prospectively only.
- Taxes (including GST where applicable) are your responsibility unless stated otherwise.
4. Your responsibilities
You agree to: (a) provide accurate information and keep your store data accurate; (b) use the service only for stores and disputes you lawfully control; (c) not submit false, misleading, or fabricated evidence — you are solely responsible for the truthfulness of all evidence submitted on your behalf and you approve our evidence templates by enabling submission; (d) comply with Shopify's terms, card network rules, and applicable law; (e) not reverse engineer, resell, scrape, or abuse the service or attempt to access other merchants' data.
We may suspend or terminate accounts engaged in fraud, abuse, unlawful activity, or non-payment.
5. Data
Our processing of personal data is described in the Privacy Policy, which forms part of these Terms. You instruct us to process your store's data (including disputed customers' personal data) to provide the service. You warrant you have the rights and lawful basis needed to give us that data.
6. Intellectual property
We own the app, site, software, and branding. You receive a limited, non-exclusive, non-transferable license to use the app for your store while these Terms are in effect. You own your store data; you grant us a license to process it to provide the service and to use aggregated, de-identified data (e.g., win rates by dispute reason) to improve the service.
7. Third-party services
The service depends on Shopify's platform, APIs, and webhooks. We are not responsible for failures, changes, or outages of Shopify, card networks, banks, or other third parties, including missed webhooks or API changes that affect deadlines.
8. Disclaimer of warranties
The service is provided "as is" and "as available", without warranties of any kind, express or implied, including merchantability, fitness for a particular purpose, and non-infringement. We do not warrant uninterrupted or error-free operation or that deadlines will always be met.
9. Limitation of liability
To the maximum extent permitted by law: (a) we are not liable for indirect, incidental, special, consequential, or punitive damages, or for lost profits, lost revenue, lost disputes, chargeback fees, or payment-processor penalties or terminations; (b) our total aggregate liability for all claims in any 12-month period is limited to the fees you paid us in that period. Nothing in these Terms limits liability that cannot be limited under applicable law.
10. Indemnity
You will indemnify us against third-party claims arising from your store, your products, evidence content you approved or supplied, or your breach of these Terms or applicable law.
11. Termination
You may uninstall the app at any time; success fees for disputes already won remain payable. Sections 2, 3 (accrued fees), 6, 8, 9, 10, and 12 survive termination.
12. Governing law and disputes
These Terms are governed by the laws of India. Courts at Udaipur, Rajasthan have exclusive jurisdiction, subject to any mandatory consumer or local-law rights you may have. Before filing any claim, both parties agree to attempt good-faith resolution via support@chargebackwiz.com for 30 days.
13. Changes to terms
We may update these Terms; material changes will be notified in-app or by email 15 days in advance. Continued use after the effective date constitutes acceptance.
